-Binding Agreement-

By accessing this Website, you acknowledge that these Terms and Conditions form a binding agreement between you and Phoenix Energy Corp. (PEC) or the successors and assigns of Phoenix Energy Corporation and you consent to be bound by these terms and conditions. If you do not wish to be bound by these Terms and Conditions, you may not use this Website. Phoenix Energy Corp reserves the right to change these Terms and Conditions at any time; accordingly, you should review these Terms and Conditions each time you view the Website. Your continued use of this Website ratifies your consent and signifies that you agree to be bound by these Terms and Conditions as they may be amended.

-Liability Statement-

-Phoenix Energy Corp (PEC) is a reseller of CNG components, parts, and kits manufactured by the suppliers to Phoenix Energy Corp. PEC assumes no express or implied liability for any component misuse or installation by any firm or individual other than a Phoenix Energy Corp certified technician. Phoenix Energy Corp offers no express or implied warranty for any CNG component other than the limited warranties offered by the component manufacturer. Therefore, I understand that Phoenix Energy Corp is only the reseller of any component sold online and will consult with a qualified technician before installation of any CNG component purchased from Phoenix Energy Corp’s online store.

-Phoenix Energy Corp's equipment liability for losses or damages, arising out of any cause whatsoever, is limited to but shall not exceed a full refund of the purchase price, or at our option, repair or replacement of the part(s). Phoenix Energy Corp shall not be liable for any consequential or incidental damages arising from the sale of parts or kits by PEC. Some states do not allow the exclusion of limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

WARNING! CNG conversions and installations consist of a volatile and flammable fuel operating under extremely high pressure. Improper installations of CNG component parts or conversion kits by untrained or unqualified personnel can result in serious injury or death to the installer, consumer, or end user. Do not attempt a repair, installation, or conversion until you are thoroughly familiar with the installation instructions and warnings contained in the manufacturer's literature.

-Warranties-

-All of the products sold by Phoenix Energy Corp, regardless of the manufacturer, are designed for alternative fuel applications.  For that reason many of our manufacturers offer a Limited Warranty on their products, either expressly stated or implied, due to the unusual stresses placed on the parts and because they have no control over how the parts are installed and used.  Most of these products are designed for off-road use only, are not legal for use on public highways.  If you have a question about the manufacturer’s limited warranty on a specific product, please e-mail jeremytalbot@phoenixenergycorp.net. Phoenix Energy Corp makes no representation of warranty other than what is offered by the manufacturer. Also, any recommendations for installation or application by Phoenix Energy Corp personnel are based on the best available information and should not be considered as authoritative and may not be relied upon by a purchaser of component parts. The purchaser assumes all risk and liability associated with the installation and use of these products.  Phoenix Energy Corp shall not be liable for any indirect, special, or consequential damages.

-All claims for shortages, damages, or defective parts must be filed by purchaser within 30 days after the delivery date, or shall otherwise be waived. Damages shall not exceed purchase price of the materials ordered.

-Phoenix Energy Corp policy prohibits returns on parts that have been used or installed. We cannot accept returns after 30 days.  Special order items and certain electronics are not eligible for return. Please email jeremytalbot@phoenixenergycorp.net for a return authorization. Returns must be in their original packaging with the purchase receipt.  We reserve the right to charge a restocking fee or refuse any exceptions. It is important to us that our customers are satisfied with their purchase, and we will make every effort to insure that you have the part you need.

-Auto Emissions & Legal Compliance-

-Phoenix Energy Corp is not responsible for Federal or State Auto Emissions compliance on your vehicle. Some parts offered for sale may not be smog-legal in your area. It is the purchaser's responsibility to be aware of his/her local emissions laws and check for the compliance and legality of any parts purchased.

-Compressed natural gas conversion kits installed by Phoenix Energy are only EPA certified kits. Non-epa certified compressed natural gas conversion kits sold are for off-road use only. Phoenix Energy Corp urges any installer to consult the Motor Age F1 Installation Guide, NFPA 52 and CGA 6.4 before attempting to install compressed natural gas conversion component on any vehicle.

-Phoenix Energy Corp collects certain personal information during account registration and order checkout. However, we will never share, give away, or sell your personal information. All personal information collected by Phoenix Energy Corp is used only for order fulfillment and internal marketing purposes. -Linking to the Website and Content-

-Phoenix Energy Corp is committed to providing world-class power and performance products to its customers. To ensure that information regarding its products and services is communicated accurately to the public, Phoenix Energy Corp asks that you adhere to the following linking guidelines.

-Phoenix Energy Corp does not object to hyperlinking to the homepage of their website(s) unless the hyperlink dilutes or tarnishes Phoenix Energy Corp’s trade name or their trademarks, or for the purpose of another company’s professional gain.
